DMCA Policy

Équipe Première respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), the text of which can be found on the U.S. Copyright Office website, Équipe Première will respond expeditiously to claims of copyright infringement committed using the Équipe Première service or website if such claims are reported to our Designated Copyright Agent identified below.

This policy describes the information that should be present in a DMCA notice to Équipe Première and outlines the process for filing a notice and a counter-notification.

Filing a DMCA Notice of Infringement

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through our site by completing the following DMCA Notice of Alleged Infringement and delivering it to Équipe Première's Designated Copyright Agent.

Upon receipt of the Notice as described below, Équipe Première will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged material from the Équipe Première service.

  1. Identification of the copyrighted work claimed to have been infringed: Provide sufficient detail to identify the copyrighted work allegedly infringed. This includes a description of the copyrighted work, a link to the original work (if available), or a copy of the copyrighted work.
  2. Identification of the material that is claimed to be infringing: Provide information reasonably sufficient to permit Équipe Première to locate the material. This includes the URL(s) on our service where the material can be found.
  3. Contact information of the complaining party: Include your full legal name, mailing address, telephone number, and email address.
  4. A statement that the complaining party has a good faith belief: State that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and under penalty of perjury: Affirm that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. A physical or electronic signature: The signature of the copyright owner or a person authorized to act on their behalf.

Please send your DMCA Notice of Infringement to our Designated Copyright Agent via our contact page, clearly marking it as "DMCA Notice" in the subject or message.

Counter-Notification Procedures

If you believe that material you posted on the Équipe Première service was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us by providing a written notification to our Designated Copyright Agent, as described below.

Pursuant to Sections 512(g)(2) and (3) of the DMCA, the counter-notification must include substantially the following:

  • Identification of the material: Identify the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • Your contact information: Include your name, address, telephone number, and email address.
  • A statement of good faith belief: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside of the United States, for any judicial district in which Équipe Première may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Your physical or electronic signature: A physical or electronic signature of the user.
